Creation of NCFCN

Decision No. 061/CAB/PM of 12 June 2003, on the creation, organisation and functioning of the National Committee for Follow up and  Coordination of the Negotiations of the “ European Union-ACP Countries” Economic Partnership Agreements

 

The Prime Minister, Head of Government hereby decrees:

 

CHAPTER I

GENERAL PROVISIONS

Article 1:

It has hereby been created at the Ministry of Economic Affairs, Programming and Regional Development, from the date of signature of this decision, a National committee for follow up and coordination of the negotiations of the “European Union- ACP Countries” Economic Partnership Agreements, hereby designated “the Committee”.

Article 2 :

(1) The committee is a consultative organ charged with studying, elaborating, expressing opinions and formulating any suggestions or proposals to the government on issues pertaining to the la conduct of  negotiations relating to the “European Union-ACP Countries” Economic Partnership Agreements and the mobilisation of related funding.

(2) As such, it has as missions :

-       to initiate and validate studies son the impact of these agreements at national, regional and sub-regional level ;

-       to identify  points of the negotiations ;

-       to see to the conformity of the formal frameworks of the negotiations with the Cameroonian nomenclature in matters of agreements and treaties ;

-       to see to the synergy between international organisations, development strategies and the process of regional integration;

-       to prepare all  earmarked meetings both at the national, regional and international level;

-       to engage at the end of the negotiations reflections and subsequent studies of adaptation and compatibility of the economic partnership agreements to development strategies.

 

CHAPITER II

ORGANISATION AND FUNCTIONING OF THE COMMITTEE

SECTION I


ORGANISATION

Article 3 :

(1) The committee is composed as follows :
President : The Minister of Economic Affairs, Programming and Regional Development ;

Members :
-       a representative of the Secretariat General of the Presidency of the Republic ;

-       a representative of the Secretariat General of the Prime Minister’s Office ;

-       a representative of the Ministry of Economic Affairs, Programming and Regional Development ;
-       a representative of the Ministry of External Relations;

-       a representative of the Ministry of Finance and the Budget ;

-       a representative of the Ministry of Agriculture;

-       a representative of the Ministry of Livestock, Fisheries and Animal Industries ;

-       a representative of the Ministry of the Environment and Forestry ;

-       a representative of the Ministry of Communication ;

-       a representative of the Ministry of Transport ;

-       a representative of the Ministry of Tourism ;

-       a representative of the Ministry of Posts and Telecommunications ;

-       a representative of the Ministry of Justice ;

-       three (3) representatives of the civil society;

-       seven (7) representatives of Decentralised Territorial Authorities.

(2) The president of the committee can, when necessary, resort to any individual or moral entity, because of their competence or expertise necessary for the examination of the questions featuring on the agenda, to participate in the deliberations of the committee with a consultative voice.

(3) The members of the committee are designated by the departments and socio-professional bodies to which they belong.

(4) The composition of the committee is certified by decision of the Minister of Economic Affairs, Programming and Regional Development.

SECTION II

FUNCTIONING

Article 4:

(1) The Secretariat of the Committee is assured by the Department of Economic and Technical Cooperation of the Ministry of Economic Affairs, Programming and Regional Development.
(2) It assists the president in the accomplishment of his missions. As such, it is charged notably :

-       with preparing convocations to meetings ;

-       with preparing files to be submitted for the scrutiny of the committee ;

-       with drawing up the reports of deliberations as well as half yearly reports of activities ;

-       with seeing to the constitution and conservation of the documents and archives of the committee ;

-       with assuring the liaison of the committee with international organisations or with any other specialized regional or sub-regional  institutions.

(3) A decision of the Minister of Economic Affairs, Programming and Regional Development shall specify the functioning of the Committee Secretariat.

Article 5:

Within the framework of its functioning the committee can create within its ranks working groups having specific missions.

Article 6:

(1) The committee meets, whenever it is necessary, on convocation of its president and at least once per quarter.

(2) The committee cannot validly deliberate except in the presence of two thirds (2/3) at least of its members. Its decisions are taken on simple majority of the members present. In case of a tie, the committee president will have the casting vote.

(3) The convocations, accompanied by the working documents, are addressed to committee members seven (7) days at least before the date of the meeting. They shall indicate the date, time, agenda and venue of the meeting.

Article 7:

(1) The report of each session of the committee is addressed to the  Secretary General at ,the Prime Minister’s Office.

(2) A copy of the said report is transmitted to each head of ministry and to each head of socio-professional body represented in the committee.

 

CHAPITER III

FINANCIAL PROVISIONS

Article 8:

(1) The duties of president and member of the committee are free of charge. However, the president, the members as well as the persons called on consultative basis and members of secretariat shall benefit a sitting allowance and can benefit from the refund of the charges generated by the sessions, upon presentation of supporting documents.

(2) The amount of the sitting allowance earmarked in by paragraph 1 above The sitting allowance session allowance session allowance mentioned in paragraph (1) above is fixed by the Minister of Economic Affairs, Programming and Regional Development.

Article 9:

The running expenses and charges of the committee shall be borne by the  budget of the Ministry of Economic Affairs, Programming and Regional Development.

 

CHAPTER IV

FINAL PROVISIONS

Article 10:

(1) The committee shall be dissolved as of right after production of the report on the strategies of adaptation of our economy to the economic partnership agreements.

(2) The Minister of Economic Affairs, Programming and Regional Development is charged with the execution of this decision which shall be registered and published according to the emergency procedure, then inserted in the Official Gazette in English and French.
